Meta Ordered to Pay $567 Million in New Mexico Child Safety Case

A New Mexico judge ordered Meta on August 6 to pay $567 million into a fund for child harm treatment and prevention, the largest single ruling yet in a wave of child-safety litigation against the company. The order also requires new age-verification tools, and Meta says it will appeal while separate cases push its total legal risk well past $1 trillion.

New Mexico First Judicial District Chief Judge Bryan Biedscheid ordered Meta to pay $567 million into a fund set up to repair harm to the state's children. The ruling closes the second phase of a public nuisance case and stands as the largest single ruling yet in a legal campaign against social media companies that has been building for years.

The case began with an undercover investigation

This state was the first to take a major technology company to trial over child safety claims and win, according to the state's Department of Justice. Attorney General Raúl Torrez filed suit in December 2023 after his office ran an undercover investigation, creating a fake profile posing as a 13-year-old girl. Torrez told CNBC the account "was simply inundated with images and targeted solicitations" from child abusers.

The fund covers treatment, prevention and years of monitoring

Of the $567 million, $420 million goes toward treatment services, with the rest covering prevention programs, screening, and five years of compliance monitoring. Beyond the money, the order requires Meta to improve age assurance tools using AI and attempt to build a dedicated under-13 age-prediction model within two years, plus a reporting portal built with schools for suspected underage accounts. However, the judge stopped short of ordering algorithm changes, citing potential conflicts with Section 230 and First Amendment protections.

Meta's exposure extends well beyond New Mexico

Between the two phases of the New Mexico case alone, Meta now faces nearly $942 million in financial exposure from a single state. Meta is also preparing for a federal trial in Oakland, California, against four states in a multidistrict lawsuit filed in 2023, where combined claims exceed $1 trillion. More than 40 state attorneys general and more than 1,300 school districts have suits pending against social media companies, and Meta has been lobbying Congress for liability protections through the Kids Online Safety Act, spending $7.08 million on federal lobbying in Q1 2026 and $5.99 million in Q2.

Meta says it plans to appeal the August 6 ruling. Wall Street has largely shrugged at each individual verdict so far, treating the sums as manageable for a company valued near $1.5 trillion.
