Grayscale is backing the CLARITY Act as the key to unlocking institutional capital, and the crypto market structure bill is now positioned for a full Senate vote. The measure cleared the Senate Banking Committee on a 15-9 bipartisan vote on May 14, 2026, after passing the US House in July 2025.
What the bill would change
The CLARITY Act tries to end the jurisdictional ambiguity around US crypto by drawing definitive lines between regulators: digital commodities would fall under the CFTC, while investment contracts would stay with the SEC. Beyond that split, the bill sets rules for token classification, disclosure, trading platforms, and custody, and even addresses decentralized finance.
That bipartisan backing stands out. Democratic Senators Ruben Gallego and Angela Alsobrooks voted in favor during the committee markup, joining their Republican colleagues.
Why Grayscale is pushing
Zach Pandl, Grayscale's head of research, has framed the bill as the key that unlocks institutional investment at scale. His reasoning is simple: pension funds, endowments, and asset managers will not meaningfully allocate to digital assets until the regulatory framework is settled.
Pandl has also singled out Ethereum, Solana, BNB, and Canton Network as the networks that stand to benefit most from institutional inflows once the bill passes.
The odds and remaining hurdles
The path is not clear yet. Polymarket odds in May 2026 put the chance of passage in 2026 at roughly 67%. Senate Republicans have signaled they are preparing updated bill text with ethics provisions, a concession apparently needed to secure enough Democratic votes for passage.
That ethics language reportedly targets conflicts of interest among officials who might hold or trade digital assets while overseeing their regulation.
